PRO 2.210.1 Service Animals
The use of service animals is governed by the federal Americans with Disabilities Act (ADA) and state law. Animals meeting the definition of “service animals” are by law allowed in and at any Kirtland facility or event where members of the public, students, and guests are allowed. Employee service animals are allowed where the individual employee is allowed. Animals not meeting this definition are not covered by federal or state law, except for residential housing, and are generally not permitted in college facilities and events.
Service Animal Definition
Service animals are dogs or miniature horses which are individually trained to do work or perform tasks for people with disabilities. Other types of animals are not included in this definition.
Service animals must by law be housebroken and under the owner’s control. Any failures to control the animal are the responsibility of the owner, including any cleanup. Failure to maintain control may result in the removal of the service animal from the facility or event. Miniature horses are further required to be of a type, size, and weight which can be accommodated by the facility, and will not compromise legitimate safety requirements.
Service Animal Restrictions
The College may limit or prohibit the use of service animals in certain locations due to health or safety restrictions. Restricted locations may include, but are not limited to: classrooms with demonstration/research animals; classrooms with dangerous equipment for which safety protection for the animal is unavailable; instruction facilities in which service animals are restricted by state or other lawful regulation; clinical instruction sites with restrictions upon the presence of service animals; or any other area where the animal’s presence would constitute a direct threat to the health and safety of the animal or to others.
Exceptions to any restricted areas may be considered on a case-by-case basis by contacting the Office of Disability Services at [email protected], 989-275-5000 x 426, or at the Disability Services office located in Student Services in the ADM Building on the Roscommon Site, or to Human Resources, with the understanding the restriction may be imposed by an entity over which the college has no operational authority.
Procedure to enroll a service animal
Students or guests requiring a service animal as a disability accommodation should file an Application for Disability Services Form available at https://www.kirtland.edu/disability-services. Employees should contact the Office of Human Resources at [email protected], call 989-275-5000 x 239, or visit the HR offices at ADM 225/226. Questions may be directed to the Office of Disability Services at [email protected], 989-275-5000 x 426, or at the Disability Services office located in Student Services in the ADM Building on the Roscommon Site, or to Human Resources.
Individuals seeking use of a service animal may be requested to answer the following questions: 1. Is the animal a service animal required because of a disability, and; 2. What work or task has the animal been trained to perform?
